4.2 Clients must obtain independent legal, financial, mortgage, and tax advicebefore proceeding with any investment.
4.3 The Company does not guarantee investment performance, rental income,capital growth, or profitability.
5. Fees and Payment Terms
5.1 Fees for services will be agreed in writing prior to the commencement of anywork.
5.2 Fees are payable in accordance with the agreed payment terms and are non-refundable once work has commenced, unless otherwise agreed in writing.
5.3 All fees are exclusive of VAT unless stated otherwise.
6. Limitation of Liability
6.1 The Company shall not be liable for: – Any loss arising from reliance oninformation provided by third parties
– Market fluctuations or changes in property values
– Decisions made by the Client based on provided information
6.2 The Company’s liability shall be limited to the amount of fees paid by theClient for the specific service giving rise to the claim, except where liability cannotbe limited by law.
7. Compliance and Regulation
7.1 ILYJA HOMES LIMITED is a property deal packaging business and is amember of an approved Property Redress Scheme.
7.2 The Company operates in accordance with applicable UK legislation,including consumer protection and anti-money laundering regulations.
8. Complaints
8.1 The Company operates a formal Complaints Policy.
8.2 Any complaint should be submitted in writing in accordance with theComplaints Policy, which is available upon request.
8.3 If a complaint cannot be resolved internally, the Client has the right toescalate the matter to the relevant Property Redress Scheme.
9. Data Protection
9.1 The Company processes personal data in accordance with its DataProtection Policy and applicable data protection legislation.
9.2 A copy of the Data Protection Policy is available upon request.
10. Confidentiality
10.1 All information shared between the Company and the Client shall be treatedas confidential unless disclosure is required by law or agreed in writing.
11. Termination
11.1 Either party may terminate the agreement in writing.
11.2 Fees incurred up to the date of termination remain payable.
12. Governing Law
These Terms of Business are governed by and construed in accordance with thelaws of England and Wales. Any disputes shall be subject to the exclusivejurisdiction of the courts of England and Wales.
